§ 24-13-154 [Complainant Bears Perpetuation Costs]

If you file a court action to preserve witness testimony before a trial begins, you will have to pay the costs that come with that process. This is true no matter what happens in the case.

These costs can include things like court fees, the cost of taking depositions, and other expenses tied to the testimony preservation process. The person who asks to preserve the testimony does not get to pass those costs on to the other side.
