§ 24-14-2 [Court Discretion on Burden Shifting]

When you're in a Georgia court, the judge gets to decide how much evidence is needed before the burden of proof shifts from one side to the other. There is no fixed rule that applies the same way in every case.

The burden of proof is basically who has to prove their point. Sometimes that responsibility can shift during a trial, meaning the other side then has to respond with their own evidence. The judge uses their judgment to decide when enough evidence has been shown to make that shift happen.

This matters because the outcome of a case can depend on who carries the burden at any given moment. If the burden is on you, you have to prove your side. If it shifts to the other party, they have to respond or risk losing on that point.
