§ 24-14-28 [Trustees Estopped from Adverse Title Claims]

If you are a trustee or someone who manages property or documents for another person, you cannot later claim that you personally own that property or have rights that go against the trust.

The idea behind this rule is simple: trustees have full access to all the paperwork and records related to the property they manage. Because of that access, they have every chance to spot any problems with ownership. The law says it would be unfair to let them use that inside knowledge to benefit themselves at the expense of the people they were supposed to serve.

This protects people who depend on trustees to manage their assets honestly. If a trustee tries to claim ownership or other rights that conflict with the trust, the court will not allow it.
