Rule 28.1 Time for Filing

If you want to ask the court to do something before your trial, like file a motion or a special plea, you need to do it by the deadline set by law. If you need more time, a judge can give you an extension, but only if they put it in writing before the trial starts.

There are also special notice rules for two specific situations. If the prosecution wants to bring up evidence that the defendant did similar things in the past, or if the defense plans to argue that the defendant was insane or mentally ill, both sides must file that notice at least 10 days before trial. A judge can make that window shorter or longer if needed.
