Rule 16 Administration of Oaths

Court clerks have the power to give oaths and sign off on sworn written statements called affidavits. This includes affidavits used to request arrest warrants or search warrants.

However, a judge is still the one who reviews and decides on those warrant requests. The clerk's role is limited to handling the oath and paperwork, not making decisions about whether a warrant should be granted.
