Rule 23.4 Notice of Intention of Defense to Raise Issue of Insanity, Mental Illness or Mental Competency.

If you plan to argue that you were insane, mentally ill, or not mentally competent at the time of the alleged offense, you must give the court advance notice. This rule follows the same requirements already set up in the Superior Court rules for these types of defenses.

The Superior Court rules (28.3, 31.4, and 31.5) cover the steps you need to take and the deadlines you need to meet when raising a mental health defense. Those same steps and deadlines now apply in Municipal Court cases too.
