Rule 5.5 Investigation of fiduciaries; criminal background information of certain nominated temporary administrators, personal representatives, conservators, or guardians.

When someone asks the court to appoint them as a temporary administrator, personal representative, conservator, or guardian, the court may look into their background before approving the appointment. This can include checking for any criminal history. The court wants to make sure the person being put in charge of someone else's estate or care is trustworthy.

If you are nominated for one of these roles, you may be asked to provide personal information so the court can run a background check. The court has the power to deny an appointment if the background check raises concerns. This process exists to protect people who may be vulnerable, like those who have died and left behind an estate, or those who can no longer manage their own affairs.
