When a judge has a personal connection to a case, one of the parties, or a lawyer involved, that judge should step aside and let another judge handle the case. This is called recusal. The goal is to make sure the case is decided by someone who has no bias or personal interest in the outcome.
If a party believes a judge should step aside, they must file a written request explaining why. This request must be filed as soon as the party learns about the possible conflict. Waiting too long to raise the issue can result in the request being denied.
The judge who is asked to step aside will review the request. If the judge agrees there is a conflict, they will remove themselves from the case. If the judge disagrees, the request may be sent to another judge to decide. The process is meant to protect everyone's right to a fair hearing.
