Rule 28 Suggestion of Death

If someone involved in an appeal dies, anyone can inform the court about it at any time during the case. The case does not automatically stop or get thrown out just because a party has died.

After the court is told about the death, it can bring in the right person to take the deceased person's place in the case. This is usually someone like the executor of the person's estate or another legal representative.
