Rule 8 Setting of Motion

When you file a motion in district court, you have to give the other side written notice at least 14 days before the hearing. This gives everyone enough time to prepare and respond before going in front of the judge.

There are two exceptions to this rule. First, the judge can decide to set a different notice period if the situation calls for it. Second, if the District Court Rules of Civil Procedure require a different amount of notice for a specific type of motion, that rule applies instead of the standard 14 days.

In short, plan on giving two weeks' notice for most motions, but check if your specific situation falls under an exception before you file.
