Rule 3 Service

When someone starts a petition to convert a non-judicial foreclosure into a court case, they have to give proper notice to everyone else involved. This means following any notice rules already required by law, plus the standard delivery rules used in regular civil court cases (found in Rule 5 of the Hawai'i Rules of Civil Procedure).

The person filing the petition does not need to issue a summons like they would in a typical lawsuit. Instead, they just need to make sure the paperwork gets properly delivered to the right people. After that happens, they must file proof with the court showing that service was completed correctly. This keeps a clear record that everyone involved was properly notified about the case.
