Rule 114 Probate Rules Applicable

When a conservator wants to sell real property that belongs to someone under a conservatorship, the same basic rules used for selling property in a regular probate case also apply here (these are Rules 65 through 72). The main difference is that anywhere those rules mention a "personal representative," you should read that as meaning the "conservator" instead, since the conservator is the one handling the sale.

There's one important extra step for conservatorship sales involving Hawaiʻi real estate: the court must always confirm the sale. This isn't optional or based on the situation. No matter what, the conservator needs to file a petition asking the court to approve and confirm the sale before it's final.

Finally, if there's a hearing scheduled to confirm this kind of sale, someone needs to submit a flag sheet for that hearing, following the process laid out in Rule 103. This helps make sure the hearing gets properly flagged and handled in the court's system.
