Rule 142 Waiver of Notice and Hearing

If everyone who has a right to receive the no-fault benefits agrees to file the petition together for a legal representative, the court can skip the usual steps of sending out notices and holding a hearing. Instead, the judge can review the request and approve it right away without anyone having to appear in court.

This rule exists to save time when there's no disagreement. If all the people involved already agree on who should be appointed as the legal representative, there's no need for a formal hearing where objections could be raised. Since everyone entitled to the benefits is already on board by joining the petition, the court can move forward quickly and grant the request based on the paperwork alone.

This can make the process faster and less costly for families, especially when speed matters for getting benefits handled properly. But it only works when all the right people agree and sign onto the petition together. If even one person entitled to the benefits doesn't join in, the court would likely need to follow the normal process with notice and a hearing.
