Rule 59 Compensation

When a special administrator is appointed to handle an estate, they get paid for their work. If the heirs or beneficiaries haven't already worked out an agreement with the special administrator about payment, the court will decide how much they should be paid. The court follows the guidelines set by Hawaiʻi state law (HRS § 560:3-719) to figure out a fair amount.

If the special administrator needs to file a petition asking the court to approve their fees, the estate normally pays for the costs of that petition. This means the money comes out of the estate itself, not from the special administrator's own pocket. However, the court can decide differently if it thinks that makes more sense for the situation.
