If you take part in mediation, arbitration, or another form of alternative dispute resolution in Indiana, the person helping resolve your case has strong legal protection. This includes mediators, arbitrators, private judges, and other neutral people approved by the court to help settle disputes outside of a regular trial.
This protection means these people cannot be sued for the decisions they make or actions they take while doing this job. The law treats them the same way it treats judges, giving them the same level of immunity from lawsuits. This applies whether they are helping with binding processes like arbitration or non-binding processes like mediation.
The reason for this rule is to let these neutral parties do their job without fear of being sued by someone who is unhappy with the outcome. It allows them to make honest decisions and give real guidance during the dispute resolution process, knowing they are protected as long as they are acting properly in their role.
