Rule 1.1504 Statement re prior presentation

If you're asking a court for a temporary injunction, you need to tell the court whether you've already asked for the same thing before. This means you or your attorney must state whether you've gone to another court or judge with this same request and been turned down.

If you were refused before, you have to say which court or judge refused you and when that happened. This rule stops people from judge shopping, where someone asks several different courts for the same order hoping one of them will say yes. By requiring this disclosure upfront, the court can see the full history of your request before deciding what to do.
