Rule 1.312 Unknown defendants, respondents, or other parties

If you're suing someone over property but don't know exactly who might have a claim to it, this rule tells you how to handle the paperwork. Instead of naming specific people, you can address your court notice to "unknown claimants" of the property. You'll need to describe the property clearly enough that anyone reading the notice would know what land or item is involved.

This comes up when someone might have an ownership interest or claim in a piece of property, but their identity isn't known. Maybe old records are unclear, heirs can't be tracked down, or previous owners disappeared without leaving contact information. Rather than letting the case stall because you can't name every possible person involved, the law lets you notify these unknown parties as a group.

Even though you're not naming specific individuals, you still have to follow the standard rules for how notices are written and delivered. This means the notice must include the same basic information and formatting required in any other case, covered under rule 1.302. The goal is to give unknown parties a fair chance to learn about the case and respond, even though you can't reach them by name directly.
