Rule 1.803 Subsequent change

If a case gets moved to a new county for trial, and then the jury can't reach a decision or a judge orders a new trial, the case doesn't have to stay stuck in that same location. The judge has the option to move the case again to another county, if there's a good reason under the standard rules for changing trial locations.

This decision is up to the judge's discretion. It's not automatic. The judge will look at the same kinds of reasons that justified the first move, like concerns about a fair trial, and decide whether moving the case again makes sense. Any new move still has to follow the standard process and requirements laid out in the related rule about changing trial locations.
