Rule 8.35 Emancipation orders

When a judge decides to grant emancipation to a minor, the court has to write up two separate documents. One document is the actual order that grants the emancipation. The other document explains the judge's reasoning, including the facts of the case and the legal basis for the decision.

These two documents are treated differently when it comes to public access. The order granting emancipation is a public record. This means anyone can ask to see it, even though most juvenile court records are kept private. However, the document explaining the judge's reasoning stays confidential. Only certain people involved in the case can access it.

This setup lets the public confirm that a minor has been legally emancipated, since that status can affect contracts, housing, and other adult responsibilities. At the same time, it protects private details about the minor's life and circumstances that led to the decision.
