Rule 8.9 Motion to waive jurisdiction

If a young person is facing a juvenile case, the county attorney can ask the court to move the case out of juvenile court and into adult court. This request is called a "motion to waive jurisdiction." This rule says that motion must be filed within ten days after the original petition (the document that starts the juvenile case) is filed.

This deadline matters because it keeps the process moving quickly and gives everyone involved a clear timeline. If the county attorney wants the case handled in adult court, they need to act fast and make that request early on, rather than waiting until later in the case.

For a young person and their family, this means they'll know fairly soon whether there's a chance the case could be moved to adult court. If ten days pass without this kind of motion being filed, the case will stay in the juvenile system.
