§ 60-442 Testimony by the judge.

If a case is in trial, the judge running that trial can't take the witness stand and testify, as long as one of the parties objects to it. This keeps the judge's role separate from the role of a witness.

The idea behind this rule is fairness. A judge is supposed to be a neutral referee who decides on evidence and legal questions. If that same judge also gave testimony, it would blur the lines between deciding the case and being part of the evidence in the case. This could make it hard for the jury to view the judge as impartial, and it could put the other side in an awkward spot if they needed to challenge or question what the judge said.

This rule doesn't say a judge can never testify anywhere. It just means that while presiding over a specific trial, that same judge cannot also serve as a witness in it if a party raises an objection. If no one objects, the situation would be different, but normally judges avoid this entirely to keep the trial fair and straightforward.
