II, Sec. 18 Number of grand jurors; number required to find indictment

A grand jury is made up of 12 people. To formally charge someone with a crime through an indictment, at least nine of those 12 people must agree.

This means not everyone on the grand jury has to vote the same way for charges to move forward. As long as nine out of the 12 members agree that there's enough evidence, the indictment can be issued. This rule sets the minimum level of agreement needed before someone can be formally charged.
