13.04 Counterclaims against the Commonwealth

This rule deals with lawsuits that involve the Commonwealth of Kentucky or one of its officers or agencies. It says that these court procedures don't give you any new or extra rights to file a counterclaim or claim a credit against the state beyond what the law already allows.

In simple terms, if you're being sued by the state, you can still fight back with a counterclaim or ask for a credit, but only if some other law already gives you that right. This rule itself doesn't create that right. It just makes clear that normal counterclaim rules don't automatically apply when the state is involved. The actual limits on what you can claim against the government come from other statutes and legal rules, not from this one.
