13.05 Counterclaim maturing or acquired after pleading

If you get sued and later realize you have a claim against the person suing you, but that claim came up or became valid after you already filed your response, you're not out of luck. You can ask the court for permission to add it to the case as a counterclaim.

This happens through something called a supplemental pleading. It's basically an update to your original response that adds this new claim. The key thing to remember is that you need the court's approval first. You can't just add it on your own; you have to ask the judge, who will decide whether to let you include it in the current lawsuit.

This rule exists so people don't have to start a whole new lawsuit every time a related claim pops up after the case has already begun. Instead, if the timing works out and the court agrees, everything can be handled together in one case.
