3.01 Commencement of action

Starting a lawsuit in Kentucky takes two steps. First, someone files a complaint with the court, which lays out what they're suing about. Second, the court issues a summons (or in some cases a warning order) to notify the other side about the case. Both steps have to happen for the lawsuit to officially begin.

The "good faith" part matters too. This means the person filing can't just go through the motions to check a box. They actually have to intend for the summons or warning order to reach the other person and give them real notice of the case. If someone files a complaint but doesn't genuinely try to notify the other side, the lawsuit may not count as properly started, which can affect things like deadlines and statutes of limitations.
