32.02 Objections to admissibility

When a deposition is used at trial, either side can still object to it. The rule says that if something in the deposition wouldn't be allowed as evidence when a witness is testifying live in court, it also can't come in just because it's part of a deposition. In other words, using a deposition instead of live testimony doesn't let someone sneak in evidence that would normally be blocked.

This means the same rules that apply to live witnesses, like rules about hearsay or relevance, still apply when reading or playing back deposition testimony. A person can raise these objections at the trial or hearing itself, not just during the deposition. There are two exceptions built into this rule, found in Rules 32.04(3) and 43.04(3), which cover specific situations where different timing rules for objections may apply.
