32.03 Effect of taking or using depositions

Here's a plain English summary of this rule:

When someone takes a deposition, that doesn't automatically make everything said in it usable as evidence in court. Just because a question was asked and answered during the deposition doesn't mean the answer becomes admissible if it wouldn't have been allowed as evidence otherwise.

This also means that if a lawyer asks questions during a deposition without objecting at the time, they don't lose their right to object later. In other words, staying quiet during the deposition doesn't count as giving up your right to challenge that testimony when the case actually goes to trial.

The main point is simple: depositions are for gathering information and locking in what witnesses say, but they don't change the normal rules about what counts as valid evidence in court.
