4.08 Constructive service; when effective

If a defendant can't be found or served in person, the court can allow "constructive service" instead. This happens through something called a warning order, which is a public notice telling the defendant about the lawsuit.

Once the court enters this warning order, there's a waiting period. The defendant is officially considered "served" on the 30th day after the warning order is entered, even if they never actually saw it or responded to it. After that 30-day mark passes, the case can move forward as if the defendant had been properly notified in person.

This rule matters because it lets lawsuits proceed even when someone can't be located. Without it, a defendant could avoid a case forever just by staying hidden or unreachable. The 30-day waiting period gives them a fair chance to find out about the lawsuit before the case moves ahead without them.
