9.02 Fraud, mistake, condition of mind

When someone files a lawsuit claiming fraud or mistake, they can't just make a vague accusation. They have to spell out the specific details of what happened. This means explaining exactly what was said or done, when it happened, and how it was misleading or wrong. Simply saying "the other side committed fraud" isn't enough; the person suing needs to lay out the facts that back up that claim.

However, this rule makes one exception. When it comes to a person's mental state, like whether they acted with bad intent, knew something was false, or meant to cause harm, the lawsuit doesn't need to go into great detail. It's enough to simply state that the person acted with malice, intent, or knowledge, without proving it point by point at this stage.

In short, this rule means facts about what happened need to be specific and clear, but claims about what someone was thinking or intending can be stated more simply. This helps make sure fraud claims are based on real specifics, not just accusations, while still allowing lawsuits to move forward without requiring proof of someone's inner thoughts right away.
