3.995 Immunity

This rule explains who these court duties actually protect. When a rule tells someone (like a lawyer, clerk, or court official) to do something, that duty is owed to the Supreme Court itself. It is not a promise made to any individual person, business, or other party involved in a case.

Because of this, you cannot sue someone just because they failed to follow one of these court rules. The rule makes clear that breaking one of these procedural duties does not give you a legal right to file a lawsuit against the person or entity who didn't follow it. If you believe you were harmed in some other way, you would need a separate legal basis for your claim, not just a violation of these procedural rules.

The note at the end simply explains the history of how these rules got their name. It shows that older rules for the Court of Appeals and appellate procedure were eventually renamed and became part of the Supreme Court's official rules over time.
