Art. 1283.9 Final decree at first hearing

When a family is trying to adopt a child, the court usually goes through a two-step process. But this rule lets the judge skip that extra step and grant a final adoption decree right at the first hearing, as long as certain conditions are met.

To qualify for this faster process, the child must have been placed with the family by a licensed adoption agency. The child also needs to have already lived in that home for at least six months before the adoption hearing takes place. The judge still has to review the same factors that would normally be considered in any adoption case before making this decision.

In simple terms, this rule rewards families who have already shown they can provide a stable, long-term home. If a child has settled in well for six months or more, the court doesn't need to drag out the process with an extra interim step. The judge can finalize the adoption right away, giving the family and child legal certainty sooner.
