Art. 1418 Physician's standard of care

When a licensed physician takes action under this part of the law, like signing an emergency certificate for someone who needs mental health treatment, the physician must act the way a reasonably careful doctor would act in the same situation. This means the doctor is expected to use good medical judgment and follow the normal standards that other doctors in the same community would follow.

The rule sets the bar for what counts as acceptable medical conduct in these cases. It does not require perfection. Instead, it asks whether the doctor acted with the same skill and care that other qualified doctors would use if they were in a similar spot, treating a similar patient, under similar circumstances.

This matters because it protects patients by holding doctors to a real professional standard. At the same time, it protects doctors who act carefully and reasonably, even if the outcome is not perfect. If a doctor's actions are ever questioned later, this rule is what determines whether the doctor met their duty of care.
