Art. 1561 Medical insurer's liability

If a parent's medical insurance would normally cover their child's medical costs, the insurance company can't refuse to pay just because the parent chose not to get certain medical or surgical treatment for the child. In other words, an insurer can't use a parent's decision to hold off on treatment as an excuse to deny coverage.

This matters in situations where parents have religious, personal, or other reasons for delaying or refusing specific medical care for their child. The insurance company still has to honor its normal coverage obligations. The parent's choice about treatment doesn't give the insurer a loophole to avoid paying for expenses it would otherwise cover.
