Art. 435 Purpose

Mediation gives people involved in a case a chance to work out their own agreement instead of having a judge decide everything for them. A neutral person helps both sides talk to each other, understand what's really at stake, and figure out what they each want.

The mediator's job is to keep the conversation productive. They help everyone see the issues more clearly, work through problems together, and look at different ways to solve the disagreement. The goal is to help both sides find a solution they can both live with, rather than one side "winning" and the other "losing."

This process only works if people are willing to talk honestly and consider different options. It gives families more control over the outcome, since they are the ones making the final decision instead of leaving it entirely up to the court.
