Art. 761 Medical treatment of children; costs

When a child needs medical or surgical care, the court can step in and order the person taking care of the child to get that care provided. This can happen on the court's own initiative or because someone involved in the case asks for it.

If the caretaker doesn't follow through and get the child the care they need, the court has the power to order the treatment itself. Before doing this, the court must give the caretaker proper notice. The court can also require the caretaker to pay for some or all of the costs of that medical care.

In simple terms, this rule makes sure a child's medical needs get met, even if the caretaker won't take action on their own. It also gives the court a way to make sure someone is held responsible for covering the costs.
