Art. 872 Motion to suppress

If a child is involved in a juvenile court case and police got evidence in a way that broke the child's constitutional rights, the child's lawyer can ask the court to throw out that evidence. This is called a motion to suppress. It means the evidence cannot be used against the child in court.

This usually comes up when someone believes the police did an illegal search, made an illegal arrest, or questioned the child without following proper rules. For example, if police searched a child's backpack without permission or a valid reason, anything they found might get thrown out of the case.

The point of this rule is to protect the child's rights during the legal process. Courts are not allowed to use evidence that was collected illegally, even in juvenile cases. If the motion succeeds, the prosecutor cannot use that evidence to try to prove the child did something wrong.
