Art. 873 Severance of causes for adjudication

When a child is accused of more than one delinquent act in the same case, the court sometimes combines all the charges into one hearing. This rule lets the judge separate the charges into different hearings if combining them would be unfair to the child or unfair to the state's case. For example, if hearing all the charges together would confuse the facts or make it hard for the child to get a fair hearing, the judge can split them up.

The rule also covers cases where a petition mixes a delinquency charge with a different type of claim, like a request to declare the child in need of care or supervision. Since these are very different legal issues, the judge can decide to hold separate hearings for each one. The main goal is to make sure the process stays fair and clear for everyone involved, rather than lumping unrelated issues together in a way that could hurt the child's chances of a fair outcome.
