Art. 1072 Service of cross-claim, citation unnecessary

When one party in a lawsuit files a cross-claim against a co-party (someone on the same side of the case), that cross-claim has to be delivered to the co-party using the normal method for serving legal papers, as described in Article 1314. This usually means sending it through the mail or having it delivered by someone authorized to do so.

The important thing to know is that the co-party does not need to be formally summoned to court with a citation. Since they are already part of the lawsuit, the court does not require that extra step. They just need to receive proper notice of the cross-claim itself so they know what is being claimed against them and can respond.
