Art. 1263 Partnership

When you need to formally deliver legal papers to a partnership, the papers must be handed directly to one of the partners. If the business is a special type called a "partnership in commendam," the papers need to go to a general partner specifically, not just any partner.

If the person delivering the papers (usually a sheriff or process server) tries hard but can't find a partner to hand the papers to, there's a backup option. They can give the papers to an employee at the business, as long as that employee is old enough and responsible enough to understand what's happening. This has to happen at a location where the partnership regularly does business.

This rule makes sure that partnerships get proper legal notice when they're being sued or involved in a court case, while also giving process servers a practical way to complete service if the partners themselves aren't available.
