Art. 1976 Service of notice

If you file a motion asking for a new trial, you have to let the other side know about it. This means sending them notice of the motion itself, along with the date, time, and location of the hearing where the judge will consider it.

The way you send this notice has to follow the rules laid out in Article 1314. That article covers the standard methods for delivering legal notices to the opposing party, such as mailing it or having it delivered by a sheriff or other authorized person.

The point of this rule is fairness. The other side needs a real chance to know what you're asking for and to show up and argue their side before the judge decides whether to grant a new trial.
