Art. 2339 Judgment debtor and creditor may bid

When property is sold at a court-ordered sale to satisfy a debt, both the person who owes the money (the judgment debtor) and the person who is owed the money (the seizing creditor) are allowed to bid on that property. Neither side is blocked from taking part in the sale just because of their role in the case.

This means the creditor can bid to buy back the property themselves, often using the debt owed to them as credit toward the purchase price. The debtor also has the right to bid and try to buy back their own property if they have the means to do so.

The rule simply keeps the sale open and fair. It does not favor one side over the other. Both parties get the same chance as any other bidder to purchase the property at the sale.
