Art. 2381 Action by seizing creditor who has been compelled to reimburse purchaser

This rule deals with a specific money-recovery situation that can come up after a court-ordered sale of property. If a creditor seized someone's property and sold it to pay off a debt, but the buyer later loses that property because someone else had a better legal claim to it (this is called "eviction" in legal terms), the creditor may have to pay the buyer back.

When that happens, the rule says the creditor doesn't have to just absorb that loss. The creditor can turn around and collect that same amount of money from the original debtor, the person whose property was seized and sold in the first place.

In simple terms, this protects the seizing creditor from losing money because of a problem with the property title that wasn't their fault. If they end up paying the buyer back, they get to pass that cost on to the debtor who owed the money to begin with.
