Art. 2640 Citation unnecessary

When a creditor uses executory process to seize and sell property (like foreclosing on a mortgage), the court does not need to issue a citation to the person who owes the debt. This is different from a regular lawsuit, where the person being sued must be formally notified with a citation before the case moves forward.

Executory process is a faster legal process used when someone has a mortgage, lien, or other written agreement that already spells out what happens if payments aren't made. Because the agreement itself already lays out the terms, the law doesn't require the extra step of citation that normal lawsuits need.

This doesn't mean the debtor gets no notice at all. Other rules in this process still require certain notices and demands before property can be seized and sold. This rule simply removes the citation requirement that would normally apply in an ordinary civil case.
