Art. 2641 Service upon, and seizure and sale prosecuted against, attorney for unrepresented defendant

When a defendant in a foreclosure-type case (called an executory proceeding) can't be found or isn't represented by their own lawyer, the court will appoint a lawyer to stand in for them. This rule says that any papers, notices, or demands that normally need to go to the defendant should instead be sent to that court-appointed lawyer.

This means the appointed lawyer becomes the point of contact for the case. Any legal action to seize and sell the defendant's property moves forward through that lawyer, not the defendant directly. The lawyer's job is to make sure someone is officially handling the paperwork and legal steps on behalf of the missing or unrepresented defendant.

This protects the defendant's rights even if they aren't around or don't have their own attorney. It also keeps the case moving forward properly, since the court can still deliver notices and get responses through the appointed lawyer instead of the process stalling out.
