Art. 3211 Duty to take possession; enforcement of claims and obligations

When someone dies and leaves an estate, the person in charge of handling that estate (called a succession representative) is legally treated as if they hold all the property that belonged to the deceased person. This means they step into the role of managing everything the estate owns, from bank accounts to real estate to personal belongings.

This person also has the job of collecting on anything owed to the estate. If someone owes the deceased person money or has an obligation that benefits the estate, the representative must take action to enforce those claims. They can't just ignore debts owed to the estate or let valuable property sit unmanaged.

In short, this rule gives the succession representative both control over the estate's property and the responsibility to protect its financial interests. They act on behalf of the estate to make sure nothing is lost and everything owed comes in.
