Art. 3247 Execution against succession property prohibited

If someone wins a court judgment against an estate (called a "succession" in Louisiana) or against the person managing that estate, they cannot use normal court enforcement tools to seize the estate's property. This applies whether the judgment was against the deceased person before they died, or against the executor or administrator handling the estate after death.

In plain terms, this means creditors cannot just show up with a court order and start taking property from an estate that's still being settled. The estate has to go through the proper administration process instead. This protects the orderly handling of a deceased person's affairs, making sure all debts and claims get sorted out correctly rather than having one creditor jump ahead and grab assets through forced collection.

This rule exists because estates often have multiple creditors and heirs with competing claims. Allowing individual seizure of property could unfairly benefit one creditor over others or disrupt the entire probate process. Instead, anyone owed money by an estate must work through the succession representative and the normal estate administration procedure to get paid.
