Art. 3248 Enforcement of conventional mortgage or pledge

If someone borrowed money and used their property as collateral before they died, the lender doesn't have to wait for the estate process to play out before enforcing that agreement. This rule makes clear that the normal rules about handling debts through succession proceedings don't block a lender from taking separate legal action to enforce a mortgage or pledge.

In simple terms, if the deceased person put up property (like a house or valuable item) as security for a loan, the lender can still go to court on their own to collect on that debt. The estate's regular process for settling debts doesn't get in the way. The lender has the right to pursue foreclosure or repossession through a separate case, rather than being forced to wait in line with other creditors during succession proceedings.

This protects lenders who have a secured interest in property, meaning they have extra legal rights because the loan was backed by specific collateral. It ensures that these secured agreements can still be enforced even while the estate is being settled.
