Art. 3505 Reduction of excessive seizure

If a creditor seizes more property than needed to cover what's owed, the person who owns the property can ask the court to release the extra amount. This can happen when someone uses a writ of attachment or sequestration, which are legal tools that let a creditor take control of property while a case is being decided.

To get some of the property back, the owner has to file a contradictory motion. This just means they formally ask the court for relief and the other side gets a chance to respond before a judge decides. The point of this rule is to keep things fair. Creditors can protect their claim by holding property as security, but they can't hold onto more than what's actually needed to cover the debt.

If the court agrees that too much property was seized, it will order the extra amount released back to the owner. This helps make sure people don't lose access to property or assets they need, beyond what's fair for settling the claim against them.
