Art. 3512 Release of plaintiff's security

When a plaintiff asks the court for a writ of attachment or sequestration, they have to put up security first. This is usually a bond that protects the other side in case the plaintiff was wrong to seize the property. This rule explains when the plaintiff gets that security back.

If the plaintiff wins the case, the security gets released once the judgment becomes final. That happens in one of two ways. Either the judgment is appealed and an appeals court agrees the plaintiff should win, or nobody appeals at all and the time limit for filing an appeal simply runs out.

In plain terms, the plaintiff cannot get their bond money back right away just because they won at trial. They have to wait until the case is truly over, either because the appeal process confirmed their win or because the other side let the appeal deadline pass without acting.
