Art. 3513 Sale of perishable property

When property that can spoil or lose value quickly gets seized during a lawsuit (through what's called a writ of attachment or sequestration), the court has a way to deal with it before it goes bad. Instead of letting the property sit and rot while the case drags on, it can be sold following the process laid out in Article 2333.

Once the property is sold, the sheriff holds onto the money from the sale. That money doesn't go to either side right away. It stays with the sheriff until the court decides who should get it.

This rule also makes clear that selling the property isn't the only option. If the person who owns the property (or has a claim to it) puts up security, like a bond, they can get the property back instead of having it sold.
